The case in which DPP Presidential candidate, Peter Mutharika, and other party heavy weights are accused of attempting to divert the constitution after the death of his brother in April by avoiding President Joyce Banda’s ascension to power among other cases went back to court today.

The hearing was adjourned last week after the presiding judge, Justice Ivy Kamanga, recused herself claiming that she knew some of the people personally.

Today, both the prosecuting and legal teams went to e briefed on the proceedings of the cases which the defendants have all pleaded not guilty to.

What has emerged is that Justice Esmie Chombo is the one who will have to take over the case from Justice Kamanga.
