The high court in Blantyre has issued an injunction stopping the order issued by President Joyce Banda to nullify the May 20 tripartite elections.
The injunction was sought by the Malawi Electoral Commission and the Malawi Law Society.
Noel Chalamanda and Patrick Mpaka, lawyers handling the matter, have told ZBS this means the commission is now free to continue counting and releasing results of the May 20 polls.
In a related development, Prof Peter Mutharika of the Democratic Progressive Party has also obtained an injunction stopping the implementation of President Banda’s directive that the Malawi Electoral Commission stops announcement of the May 20 poll results and call for fresh elections within 90 days.
The DPP injunction was obtained on Saturday afternoon by professor Mutharika’s lawyers, Kalekeni Kaphale and Frank Mbeta.
Unofficial results of the May 20 presidential election and projections by the Malawi Electoral Support Network indicate that Professor Mutharika is in the lead.
