President Joyce Banda is not eligible to the benefits that a former President is supposed to get, renowned lawyer Wapona Kita has weighed in.

According to the argument, Section 2 of the privileges due a former head of state indicate that the privileges shall flow to a former President who was elected into office as a President. Banda was eventually not elected as a President but ascended to office when Bingu wa Mutharika died.

“S. 2 of the President’s (Salaries and Benefits) Act defines ‘Former President’ as the Person who was duly elected and took office as President of the Republic of Malawi. For argument’s sake, according to this section which benefits is JB entitled to?” Kita has wondered.
