The high court in Lilongwe has declared the new Malawi Congress Party (MCP) National Executive Committee leadership unconstitutional and illegal.
The court ruling in favour of MCP member Chatinkha Chidzanja Nkhoma and Dennis Namthumba has also restrained the MCP leadership from dismissing or suspending members from the party.
“The new Malawi Congress Party national executive committee (NEC) is unconstitutional. and illegal in terms of Article 30 of the Constitution of the Malawi Congress Party (MCP) and as such all its resolutions are unconstitutional, illegal and of no effect,” reads part of the judgment.
The ruling means that Chatinkha and Nanthumba can continue using party insignia and other material in whatever political activity they undertake be it press conferences, party meetings among other events.
The party some two months ago expelled and suspended some of its senior members on allegations bordering on indiscipline.
Meanwhile, MCP Second Deputy Secretary General Eisenhower Mkaka says the party is yet to receive the judgment.
