Justice Healey Potani has informed the court that on Thursday the Supreme court of Appeal will be sitting to decide on an appeal by Malawi Electoral Commission (MEC) and Presidential candidate Peter Mutharika to strike out the elections case.
Attorney General Kalekeni Kaphale earlier requested the high court to throw out the elections case application by Malawi Congress Party (MCP) and United Transformation Movement (UTM).
However, a five judge panel threw out the application by the AG hence the appeal to the supreme court.
According to Judge Potani, the high court might not be siting on the day giving room to the Supreme Court.
The appeal follows the Constitutional Court’s earlier ruling against the two respondents’ preliminary objection against the election petition.
Ex vice president Saulos Chilima and MCP’s Leader Lazarus Chakwera are challenging May 21 presidential results whereby MEC declared President Peter Mutharika Democratic Progressive Party (DPP) candidate was declared winner.
