Supreme Court of Appeal has agreed with the Constitutional Court decision that the Attorney General (AG) Kalekeni Kaphale was not supposed to represent Malawi Electoral Commission (MEC) in the presidential elections case.
Justice Frank Kapanda said this as highest court was delivering its ruling on the appeal case in the presidential elections case.
The court further finds that the conduct of the AG was not consistent with constitutional responsibilities to ensure protection of the law.
Kapanda added that the AG was in conflict with the law and was compromised as a principal legal advisor of government.
The court has further faulted the Constitutional Court for not stopping the Attorney General.
