The Supreme Court agrees with the observation by the Constitutional Court that majority means 50 percent + 1 votes.

The court said there were conflicting decisions on the issue of majority votes , one being in the Gwanda Chakuamba case where the Supreme Court did not say the word means use of 50+1.

The meaning of majority votes as stated in the constitution sparked debate after the Constitutional Court ruled that Malawi should use the 50+1 system in the fresh presidential election after nullification of the May 21, 2019 election.

The lower court also indicated that by saying one should be declared winner of a presidential election after obtaining majority of the votes the constitution meant the winner should get more than half of the total votes.
