Chief Resident Magistrate, Patrick Chirwa, has adjourned to a later date, the case of Stuart Kalungama accused of defiling his 9 year old stepdaughter in Lilongwe, to allow Kalungama to be examined by medical experts.

This was based on Kalungama’s lawyer, Edward Chagalamuka, who said his client has acute diarrhea and headache such that he would not stand trial today.

State lawyer, Eunice Ndingo, said that the state was ready to start parading witnesses, including a medical doctor from Kamuzu Central Hospital who examined the girl.

However, the State dismissed the claims in the application saying there has been no information from Maula prison reporting that the suspect is sick.

But in his ruling Chirwa ruled that the suspect be taken to the hospital as soon as possible for examination and that the results should be furnished before the court not later that today Monday.

Eunice Ndingo described the application by the defense team as not genuine but said they have accepted since the suspect is still in their custody.
