High Court Deputy Registrar Anthony Kapaswiche has today failed to deliver his ruling on whether to dismiss Former President Peter Mutharika’s review application or not.

On Mondaythis week, lawyers representing HRDC, Magistrates association and Malawi Law Society filed an application requesting the Court to dismiss Mutharika and Former government Chief Secretary Lloyd Muhara’s costs review application.

According to the claimants, the defense delayed in furnishing them with evidence documents which is wrong as documents are supposed to be served 21 days before hearing.

Khumbo Soko lawyer representing the claimants said they want the court to dismiss Mutharika and Muhara’s application as hearing on the matter cannot come 12 days after they submitted documents.

But Charles Mhango lawyer representing Mutharika and Muhara described the dismissal application by the claimants as farfetched and ill-conceived saying the best thing they could have done was just to request for more days to go through the documents.

Deputy Registrar Kapaswiche then settled for today Friday as a day he shall rule on the matter but this has failed to happen saying the ruling is not yet ready.

Meanwhile, the Claimants says they are making progress in their proceedings to get the k69.5 million from Mutharika and Muhara.
