In Kenya, a 71-year-old man has been sentenced to life imprisonment before a Kisumu court for allegedly defiling his 15-year-old daughter in 2020.

Bernard Ngonga received his sentencing before Everlene Onzere the Principal Magistrate of Tamu law court in Muhoroni sub-county within Kisumu.

The court heard that Ngonga allegedly defiled and impregnated his two daughters between the months of June and September last year but however, was yesterday found guilty and charged for defiling the younger one.

The court established that Ngonga would threaten his daughter with a kitchen knife before defiling her and would threaten her not to report him to anybody.

When the minor tried to seek help, all her efforts went futile as nobody was willing to assist her to get justice.

After their parents separated, her father re-married a second wife whom the minor would report the indecent act his father was doing to but all she did was to turn her down.

“She sneaked into the room where I was sleeping and slept with me and threatened to kill me if I let the information out,” she told court.

The minor told court that after she was turned down by her step-mother, she reported the incident to the village elder who also turned her down claiming that she was lying and in return told her to report the incident to the police who immediately took action and arrested the suspect.

The court also found out that his father, who was a herbalist turned his working space into a room where he would defile her biological daughter.

The minor got pregnant and nine months later, she gave birth to a child who however died at birth but was proved by medical report to be Ngonga’s child.

According to the witnesses who testified before court, they told the court how Ngonga would commit the indecent act with his own biological daughters but on his side, he denied all the accusations that were pressed against him urging that he had been framed.

While delivering her rulling, the magistrate told court that the younger daughter’s case had been proved beyond a reasonable doubt with the medical reports indicating that he indeed committed the evil act.

She, therefore, found Ngonga guilty of the offence of incest contrary to Section 20 (1) of the Sexual Offenses Act.

“I therefore proceed and charge the accused to life imprisonment,” said the magistrate.

She added that the accused person has 14 days to file his appeal if he is not contented with the judgement.
