Justice of Supreme Court of Appeal Lovemore Chikopa has adjourned to a later date his ruling in a case in which Paul Mphwiyo, former budget director and 18 others are appealing against the refusal by the high court to re-start their case.
Mphwiyo and the others wanted their 2.4 billion Kwacha Cashgate case to recommence after it was taken over by a new judge.
The case that initially being heard by Judge Esmie Chombo who has been deployed to a diplomatic assignment is now being handled by High Court Judge Ruth Chinangwa.
However, before the commencement of the case, Mphwiyo and his co-accomplices asked Chinangwa to nullify the case and recuse herself.
However, Chinagwa dismissed the application, a development which forced Mphwiyo and the others to appeal against her decision in the Supreme Court of Appeal.
The case had over 30 state witnesses and over one hundred documents which form part of the evidence.
Dr Steve Kayuni, the director of public prosecution has argued that there is no valid reason which warrant the re-start of the case.
