Chief Resident Magistrate Madalitso Chimwaza has adjourned to July 11, 2022 an extradition case involving Prophet Shepherd Bushiri and Prophetess Mary Bushiri.
Bushiri’s Public Relation Officer Ephraim Nyondo has confirmed of the development in a statement posted on his official facebook page.
“The extradition case involving Prophet Shepherd Bushiri and Prophetess Mary Bushiri has been adjourned to 11th July for a ruling whether South African witnesses should testify in a court in South Africa or come physically to Malawi to testify,” said Nyondo.
When the case resumed this morning, the State through Director of Public Prosecutions Steve Kayuni has applied to have witnesses record their testimony in South Africa due to logistical challenges to bring them to Malawi.
According to the State, it would be very expensive to bring the witnesses to Malawi.
Kayuni cited expenses such as flight tickets and accommodation.
But the defense through lawyer Wapona Kita has challenged this application saying the issue was already dealt with by the same Court in its ruling of 8th June 2021 where the Court decided that the reasons given by the State not to bring the witnesses to Malawi were not convincing enough.
He said because the court already decided on the matter, the same court cannot revisit its own decision.
