The High Court in Blantyre has adjourned to Friday a case in which the Malawi Local Government Association (Malga) is seeking a judicial review in the matter concerning transfer of some district commissioners.
Malga through its lawyer Davies Njobvu today asked for directions from the court following the Attorney General’s application for a discharge of leave for the judicial review.
In his application, the AG argued that Malga is not an interested party in the matter as the issue only involves the DCs and not Malga as an association.
Justice Jean Kaira has since adjourned the matter to Friday to give time for both parties to submit their arguments on the matter.
Proceedings on the case will depend on the outcome of the AG’s application.
On September 29, 2022, Malga took the government to court accusing it of making unilateral decisions by sidelining both the councils and the association.
It argued the decision by the Office of the President and Cabinet to redeploy about 10 DCs and two chief executive officers to central government is unlawful and unprocedural.
