The Malawi Law Society (MLS) is advocating for a review of the guidelines that empower the President to pardon prisoners. This follows the recent pardon of 200 prisoners, including politician Uladi Mussa, who was serving a 6-year jail term for abuse of office and corruption.

Mussa’s release has sparked mixed reactions from the public, with some arguing that it sends a bad signal on the fight against corruption.

MLS Honorary Secretary Gabriel Chembezi has expressed support for the Special Law Commission on the Development of Sentencing Guidelines, in appealing for clarity on the scope of the president’s pardoning powers.

Specifically, they are seeking clarity on the extent to which the President’s pardoning powers can be exercised in relation to convicted public figures.

The President’s power to pardon prisoners with minor offenses and those who demonstrate good behavioral reform is part of the Easter celebrations.

However, the MLS’s call for a review of the guidelines reflects the need for clarity on the limits of the President’s power to pardon.
