Supreme Court of Appeal has scheduled a hearing for May 2nd, 2023, regarding an application by Ombudsman Grace Malera to vacate an injunction obtained by the Malawi Energy Regulatory Authority (MERA).
The injunction has prevented the release of an enquiry report on the recruitment of MERA’s Chief Executive Officer, Henry Kachaje. Malera has stated that her office is seeking the court’s permission to release the contents of the report.
MERA secured the injunction in November 2021, minutes before the Ombudsman’s scheduled release of the report. Malera attempted to vacate the injunction at the High Court, but the application was dismissed by Judge Justice Kenyatta Nyirenda.
The Supreme Court’s hearing on the matter in May will determine whether the injunction will be lifted.
