In dramatic turn of events state prosecutors says Uladi Mussa was not pardoned rather was just released from prison.
This has been revealed as the Supreme Court heard appeal application against the five year jail term for the pardoned Uladi Mussa.
Meanwhile the state has withdrawn the appeal and now the focus on the consequences of the pardon against the conviction.
Kamudoni Nyasulu one of the state lawyers said as it stands Mussa is still convicted as was released upon approval by prison officer and not the President.
Nyasulu added by arguing that the case is worst of time in the high court but deserved to be handled in the lower court.
According to Nyasulu conviction and sentencing are judicial matters while pardoning is done while exercising powers conferred to the executive.
Meanwhile Chancy Gondwe one of the defense lawyers says it is disturbing to hear from the state that Mussa was not pardoned as they were the ones to get the documents from the President.
Gondwe further states that they know that the pardoning means that all sins were erased despite the fact that there were no conditions attached.
