Attorney General Thabo Chakaka Nyirenda has moved to challenge the ruling by High Court Judge Mike Tembo that has nullified Immigration Department Director General Charles Kalumo’s appointment.
AG’s office spokesperson Emmanuel Lawyer has confirmed of the development in an interview with the press.
According to Lawyer, the AG has applied for an order of stay of the judgement pending a review of the ruling by the Supreme Court of Appeal.
“We want Judge Tembo’s ruling put on hold. Our application is based on a number of grounds including that the judge erred in law by nullifying the appointment of Kalumo without giving him the right to a prior hearing,” says Lawyer.
The AG’s office also argues that Zidana had no locus standi to bring his application before the court for judicial review.
Meanwhile, Immigration officers yesterday went to town celebrating the High Court ruling.
