The High Court of Malawi in Blantyre has all but doubled a convicted defiler’s sentence stressing the initial one by a lower court was not stiff and deterrent enough.
In her determination after reviewing the earlier verdict yesterday on 22 August 2024, Judge Chimwemwe Kamowa increased the penalty for the man who defiled his five-year-old biological daughter from 21 to 40 years IHL.
Judge Kamowa expressed concern at the nature of the crime, saying it displayed betrayal of trust and inflicted psychological trauma on the victim.
She lamented that rather than being a guardian, protector and source of safety for his child; the convict acted in a manner that shattered the little girl’s trust, leaving her psychologically traumatized.
The convict, whose identity is being concealed to protect the minor, was being represented by the Legal Aid Bureau.
