Former chief executive officer of the Tobacco Commission, Joseph Chidanti Malunga, has filed a lawsuit against the Comptroller of Statutory Corporations, Peter Simbani challenging the decision to appoint commissioners to the Tobacco Commission on February 9, 2024, without statutory mandate and the knowledge of the Minister of Agriculture, Sam Kawale.
Malunga has also named Kawale as the second defendant in the case, citing the Minister’s failure to exercise his statutory mandate to appoint the commissioners.
According to court documents which Nation Online has seen, Chidant Malunga has applied for permission to seek judicial review out of time.
The application, filed at the High Court in Lilongwe on August 26, 2024, also requests an interlocutory injunction to restrain the appointed commissioners from performing their duties until the main matter is resolved or further orders are issued by the court.
