Malawi Congress party has vacated the injunction obtained by Gustave Kaliwo and others which was restraining the party from suspending them from their various positions and from the party.

This comes after Kaliwo and others said they will not vacate the injunction despite the party’s National Executive Committee reinstating them.

on Tuesday Kaliwo through his lawyer Kalekeni Kaphale obtained a fresh injunction restraining the MCP leadership led by Dr. Lazarus Chakwera from effecting the suspension of him and four top officials namely; Director of International Relations Tony Kandiero, Spokesperson Jessie Kabwila, First Deputy Secretary General Chatonda Kaunda and Vice President Richard Msowoya.

The injunction also stopped MCP from holding the much awaited convention.

The same day MCP filed an application asking the Court to vacate the injunction and today the Supreme Court has granted a stay of execution of the injunction order.

“It is hereby ordered that the interlocutory injunction granted herein by the Honourable Justice Tembo in the court below dated 8th May be and is hereby stayed pending the hearing of the inter partes application for the stay,” read in party the court ruling.

The Supreme Court has since set May 17 as the day the court will hear the  inter-party hearing.

Meanwhile Kaliwo is yet to comment on the matter.
