Lawyers for Malawi Congress Party (MCP) have applied in the Constitutional Court to have President Peter Mutharika and Malawi Electoral Commission (MEC) chairperson Justice Jane Ansah summoned to court for the on-going high-profile presidential election results case.
Mutharika, who was declared winner in the disputed May 21 tripartite election, is the first respondent in the case and Malawi Electoral Commission (MEC) is the second respondent.
One of the lawyers for Chakwera, Titus Mvalo confirmed of the application in an interview with Zodiak Broadcasting Station (ZBS).
Mvalo said Mutharika as the first respondent he will be required to be in court to give his side of the story.
Lawyers for Mutharika have quashed the application by MCP lawyers, saying Mutharika will not avail himself in court.
Earlier, President Mutharika through his lawyers applied for the dismissal of the case on grounds that the application made by Chilima and Chakwera lacked basis.
But the panel of five Judges dismissed the application.
Meanwhile the case is scheduled to resume today afternoon at the constitutional Court in the capital Lilongwe and the Attorney general will continue cross-examining Dr. Saulos Chilima.
