The Supreme Court of Appeal has thrown out an appeal for stay by Malawi Electoral Commission (MEC) and Democratic Progressive Party (DPP) regarding Constitutional Court’s Judgement nullifying May 2019 presidential election.
The application has been dismissed with costs, and all the three grounds thrown out.
The Supreme Court ruling means that MEC will have to continue with preparations for fresh presidential polls.
Speaking after the judgement was delivered MEC lawyer Tamando Chokhotho said that they will now be focusing on the appeal case which will commence on 15 April, 2020.
On Thursday, the panel of 7 judges of the Supreme Court of Appeal met in a chamber and listened to arguments from petitioners and respondents.
On February 3 this year, Constitutional Court nullified May 21, 2019 presidential elections and reverted the presidency positions prior to the polls, demoting Everton Chimulirenji and reinstating Saulos Chilima.
