The Lilongwe Senior Resident Magistrate Court is this morning expected to hear an application for discharge and unconditional release of four directors of Foundation for Irrigation and Sustainable Development (FISD).
The four are Frank Mwenechanya, Kondwani Nanchukwa, Arthur Mpama and Moses Chirambo.
They were arrested in November 2020 for allegedly defrauding government and development partners.
This is in connection with a 2.4 Billion Kwacha contract, government awarded FISD Limited to construct, rehabilitate and expand gravity fed water supply in Ntcheu district.
However, government terminated the contract on grounds of departure from specifications of contact, defective works and failure to pay wages.
Since then, the case has stalled as the state is yet to start prosecuting the four.
But, the four through their lawyer Gift Nankhuni have filed an application for discharge and unconditional release, without an option for the state to reinstate the case.
They are also asking the court to order that the bail conditions should eventually fall away after discharging them.
