Magistrate Soka Banda has adjourned to Tuesday for ruling on a case in which the State wants a police officer Andrew Chagaga who was convicted of rape to be sentenced by the High Court and not the Magistrate Court.
Speaking after making the application, lawyer Chikondi Chijozi who is representing a girl,described Chagaga as “the worst offender” who deserves a stiffer penalty.
She said despite being a police officer, Chagaga demonstrated that he is not fit for the job by raping the victim twice in custody and later released and dumped her in the street during odd hours.
Chagaga was convicted of raping a girl twice in custody at Limbe Police Station and is currently remanded at Chichiri Prison waiting for sentencing.
The State is being represented by Trevor Mphalale, Ruth Thoko Kaima and Chikondi Chijozi from Centre for Human Rights,Education,Advice and Assistance CHREAA and Southern Africa Litigation Centre SALC.
