Zomba Principal Resident Magistrate have found  Chisomo Francisco Gomani with no case to answer over the allegation of having sexual intercourse with a minor.

Gomani who is a a teacher at Zobwe Primary was arrested on 27 October 2023 for suspecting him being allegedly defiled one of his pupils.

After his arrest, Temwa Chirwa a relative to Gomani, went to Legal Aid Bureau offices to seek legal assistance on the matter.

Senior Legal Aid Advocate Hanleck Ching’anda and Assistant Legal Aid Officer Tadala Ching’amba took over the case to court proceedings.

During the court hearing, the suspect dined the charges and the state brought four witnesses including a mother of the defiled child and medical practitioners.

The court heard through the child’s mother that on 27 October 2023, Gomani’s wife who happens to be a sister to her,  went mother’s home to tell her that her husband is having an affair with her daughter.

The went back to Gomani’s house where they found hi and the child who escaped at the scene and besides them there was already used bloody condom.

A second witness identified as Catherine Maganizo who is also a medical personnel, told the court that the medical reports reveals that  minor had sex for several times.

In her time, the minor told that court that on the stated date, she went there with her friend to assist Gomani marking exams but she didn’t found him at home and nothing happened there.

After state witnesses, Legal Aid Bureau representative found the evidences valueless to accuse Gomani in defilement case.

In his ruling, Principal Resident Magistrate Martin Chipofya agreed with Legal Aid Bureau and acquitted Teacher Chisomo Francisco Gomani with no case to answer.
