The Mazabuka Local Court In Zambia has dismissed a case involving a 34-year-old Seventh Day Adventist Church elder who was sued for adultery.
In this case, Sylvester Mweetwa had dragged Mata Musokotwane to court, claiming K15,000 in compensation after finding the elder with his wife at a lodge in Mazabuka.
The court heard that Musokotwane had agreed to pay Mweetwa K25,000 for the incident, making a deposit of K1,000 and surrendering his 43-inch Hisense Plasma television valued at K5,000.
However, the defendant denied having intercourse with Mweetwa’s wife, stating that the ordeal was a setup by the couple to extort money from him.
He accused Mweetwa’s wife of sending him luring messages to arrange a meeting using an unrecognized number.
In delivering the judgment, Magistrate Muleya Siakasungu, sitting with Magistrate Reagent Zandu, dismissed the matter, stating that there was no penetration between Mweetwa’s wife and Musokotwane to substantiate the adultery claim.
The parties were ordered to bear their own costs, and Mweetwa was informed of his right to appeal within 30 days if unsatisfied with the ruling.
Additionally, he was ordered to return the television set and the K1,000 he obtained from Musokotwane.
Mweetwa told the court that he would appeal the case and wished to hold on to the television and the money in the meantime.
