The High Court in Lilongwe has adjourned to a later date the murder case in which the state is accusing Lester Maganga of killing Allan Wittika.
High Court judge Mzonde Mvula said this today after hearing oral submissions from both the defence and the state.
He said he will give a five day prior notice to the concerned parties after analysing 273 paged files containing evidence before giving his ruling whether or not Lester Maganga has a case to answer.
In his submission state advocate Pilirani Masanjala prayed that the court finds the accused with the case to answer based on the evidence tendered through their 12 witnesses on the two counts of possessing a live bullet without a license and murder.
However the defence lawyer Gonjetso Dikiya argues that the state has not provided sufficient evidence to prove the possession of the live bullet and procuring the death of the late Wittika hence asking the court to acquit his client.
